Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365/34 of the Indian Penal Code.

Petitioner happens to be father of F.I.R. named accused, Nehal Singh and it is alleged that Nehal Singh and other F.I.R. named accused kidnapped the informant's daughter. Petitioner is not named in the first information report but in course of investigation, he was arrested on the ground that one so-called letter said to be written by the victim was recovered from his conscious possession and, accordingly, the police

Patna High Court Cr.Misc. No.30549 of 2016 (2) dt.05-08-2016 2/2 officials came to conclusion that petitioner had also participated in the alleged crime.

Submission on behalf of the petitioner is that the victim was in love with Nehal Singh and as a matter of fact, the victim eloped with aforesaid Nehal Singh and petitioner is not aware about the whereabouts of Nehal Singh as well as victim. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar (Lalmatiya) P.S.
