1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Special Case no.40 of 2023 arising out of Jogbani P.S. Case no. 131 of 2023 registered under sections 21 and 22 of the NDPS Act.
3. As per the prosecution case, the cough syrups, injections etc. was recovered from the possession of the three accused persons including the petitioner herein.
4. It is submitted by learned Senior counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He is in custody since 27.5.2023 and chargesheet has been submitted in the case. Coaccused Sadru Jama has been

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the petitioner having remained in custody for 9 months since 27.5.2023, not having any criminal antecedent, chargesheet having been submitted in the case and grant of bail to the above named coaccused, the Court directs the petitioner to be enlarged on bail in connection with Special Case no.40 of 2023 arising out of Jogbani P.S. Case no. 131 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions-cum-Special Judge, NDPS Act, Araria.
