JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code and sections 3(1)(v) & (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. It is alleged that the informant paid Rs.6,0,1000/- to Kameshwar Prasad Singh who entered into agreement for sale of the land in favour of the informant but when the informant went to remind him then the petitioner being the son of Kameshwar Prasad Singh and Kameshwar Prasad Singh abused the informant by calling the caste name.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.10201 of 2015 (2) dt.22-04-2015 2/2 that the thrust of accusation is against Kameshwar Prasad Singh and admittedly the occurrence took place inside the house of the petitioner, hence it cannot be said to be a plce of public view. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna in connection with Shastrinagar P.S. Case No. 702 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
