The petitioner, in the present case, is seeking regular bail in connection with S.T.No.206/18, arising out of Chandan P.S. Case No. 109 of 2017, registered for offences alleged under Sections 304(B)/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that the petitioner is the father-in-law of the deceased and has been falsely implicated in the present case. The mother-in-law has been granted privilege of anticipatory bail in Cr.Misc.No.24022 of 2018 vide order dated 30.04.2018.
Learned APP for the State has opposed the prayer
Patna High Court Cr.Misc. No.51782 of 2018 (2) dt.20-09-2018 for bail and submits that the petitioner is the father-in-law and there are allegations against him. It is however stated that the investigation of the case has been completed and charge-sheet has already been filed.
In the given facts and circumstances of the case considering the fact that the mother-in-law of the deceased has already been granted privilege of anticipatory bail and this petitioner being the father-in-law has been made accused along with other persons of the family on the allegations in respect of which now the investigation is complete, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions JudgeII, Banka in connection with S.T. No.206/2018, arising out of Chandan P.S. Case No. 109 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
