JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-11-2019 The petitioner seeks bail in anticipation of his arrest in connection with Baikunthpur P.S. Case No. 163 of 2018, dated 04.07.2018, instituted for the offences under Sections 420 and 34 of the Indian Penal Code and Sections 30(a), 41(i)(ii) of the Bihar Prohibition and Excise Act, 2016.

The vehicle belonging to petitioner was intercepted and was found to be loaded with 730 litres of liquor. The case of the petitioner is that the vehicle was given to one Ashok Kumar to ply on roads on commercial basis. The petitioner did not have any idea that aforesaid Ashok Kumar

Patna High Court CR. MISC. No.48012 of 2019(4) dt.16-11-2019 2/2 had been using the vehicle for transportation of liquor. Two other vehicles also were intercepted along with the vehicle of the petitioner and the owner of one the vehicles has been granted anticipatory bail.

The petitioner does not have any criminal antecedents.

Considering the facts aforestated, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-II-Cum-Special Judge, Gopalganj, in connection with Baikunthpur P.S. Case No. 163 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
