2. The petitioners have preferred this application for

Patna High Court CR. MISC. No.50358 of 2025(3) dt.15-11-2025 2/3 grant of regular bail in connection with Alinagar P.S. Case No. 76/2024 dated 24.06.2024 registered for the offences punishable u/ss 457 and 320 of the Indian Penal Code.

3. As per the prosecution case, some unknown miscreants are alleged to have entered the house of the informant and committed theft of some articles.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners are not named in the FIR. The name of the petitioners has sprung up in the confessional statement of the apprehended co-accused persons. Nothing has been recovered from the conscious possession of the petitioners. The petitioners, namely, Ravi Kumar Sahani and Rohit Sahani have six criminal antecedents and the petitioners, namely, Ajay Sahani and Sanjay Sahani have four criminal antecedents as stated in para 3 of the bail petition. The petitioners, namely, Ravi Kumar Sahani and Rohit Sahani are in custody since 07.09.2024 and the petitioners, namely, Ajay Sahani and Sanjay Sahani are in custody since 10.08.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.50358 of 2025(3) dt.15-11-2025 3/3 of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Benipur at Darbhanga in connection with Alinagar P.S. Case No. 76/2024, with the condition/s:- (i). The petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to be cancelled.
