The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 302, 307, 504, 506 of the Indian Penal Code and section 27 of the Arms Act. The prosecution case, in short, is that while the informant and others were returning from a tilak ceremony, the accused persons surrounded them and fired, as a result of which one person succumbed to the injury.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The main allegation is against the co-accused Golu Pandey who is alleged to have fired upon the deceased. No

Patna High Court Cr.Misc. No.52565 of 2018(2) dt.10-09-2018 2/2 specific overt act has been alleged against the petitioner. At best, the petitioner is said to be a member of unlawful assembly. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 326/18, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
