====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 29.06.2019 in connection with Compliant Case No. 105 C-2 case No.-2019 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the recovery of 71 liters and 310 ml of wine has been made from the side of the pit which is located near the open boundary of the petitioner's compound and not from the conscious possession of the petitioner.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand)
