The present regular bail is filed with reference to Bihta P.S. Case 441 of 2022 registered under Sections 307 read with 34 and 120(B) of the Indian Penal Code and section 27 of the Arms Act. The alleged incident has taken on 03.05.2022 between 7.00 P.M to 7.30 P.M. It is alleged that Kallu and Daya (present petitioner) confronted informant and took out the pistol from their waist and and opened fire upon him and bullet struck in the left side of his chest and the informant fell down on the ground. All the three accused escaped from the spot. It is alleged that present petitioner and 5 others have hatched conspiracy for committing murder of the informant.

The alleged role of the petitioner is evident from case diary which has been taken note of by the Additional

Patna High Court CR. MISC. No.52358 of 2022(2) dt.09-12-2022 2/2 Sessions Judge-I, Danapur while B.P. No. 819 of 2022 dated 28.07.2022.

In the light of these facts and circumstances the petitioner is alleged to have involved in a heinous crime and he is not entitled to bail consideration at this stage. Accordingly, regular bail of the petitioner is hereby rejected.
