ANJANA MISHRA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Danapur P.S. Case No.147 of 2018 for allegedly having committed the offence under Sections 147, 148, 149, 333, 307, 379, 337, 447, 354, 435 and 436 of the Indian Penal Code.
Learned counsel for the petitioners submits that there is general and omnibus allegation against the present petitioners as about 50 persons were found standing on the road after the alleged murder of one co-villager and no specific role has been attributed to them. It is further submitted that the petitioners have been made accused on
Patna High Court Cr.Misc. No.62637 of 2018 (2) dt.08-10-2018 2/2 mere suspicion and similarly situated co-accused person has since been extended the privilege of anticipatory bail in Cr. Misc. No.37081 of 2018 vide order dated 03.07.2018. In view of the aforementioned facts and circumstances and that the petitioners have no criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur, in connection with Danapur P.S. Case No.147 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
