The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,420 and 504/34 of the Indian Penal Code. It is alleged that the petitioners approached the villagers claiming themselves as the President and the Member of Adarsh Krishak Sewa Swablambi Cooperative Samitee Ltd. and asked them to open account and make daily deposit to get the amount with 4% interest after one year along with the facility of loan. Patna High Court Cr.Misc. No.10227 of 2015 (2) dt.22-04-2015 2/3 informant was paid only Rs.9760/- through cheque but the balance amount was not paid.

It is submitted by the learned counsel for the petitioners that the petitioners are ready to make payment of the balance amount along with interest as shown in the records to have been deposited on behalf of the informant within a period of two months. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on provisional anticipatory bail for three months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Samsatipur in connection with Khanpur P.S. Case No. 163 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail of the petitioners will be confirmed by the learned court below on return of the balance amount of the informant with 4% interest as alleged
