JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-08-2016 Perused the report sent to this Court vide letter no.47 dated 26th July, 2016 by the trial court.

It would be evident from the aforesaid report that though charges have been framed under Sections 25(1-B)(a) and 26 of the Arms Act as also under Sections 3 and 4 of the Explosive Substance Act on 12.8.2015, no witness has turned up so far before the court to depose in the case.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 11th January, 2014 in connection with Maner P.S. Case No.18 of 2014 and there is no likelihood of conclusion of trial in near future. Taking into consideration the facts and circumstances of the case, the petitioner, namely, Manohar Rai, is directed to be

No.28199 of 2016 (3) dt.17-08-2016 2/2 released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Danapur in connection with Sessions Trial No.459 of 2015 arising out of Maner P.S. Case No.18 of 2014.
