JUSTICE SUDHIR SINGH ORAL ORDER 04-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 363 and 366(A) of the Indian Penal Code.

The allegation against the petitioner is that he abducted the elder daughter of the informant, aged about 14 years studying in Class- IX on 18.3.2014with intention to marry with her who used to take tuition from the petitioner.

On behalf of the petitioner it is submitted that the petitioner has got no criminal antecedent. The petitioner has been falsely implicated in the present case. The aforesaid fact is supported from the statement of the victim recorded under Section 164 Cr.P.C, which is Annexure 3 to the present application. The

Patna High Court Cr.Misc. No.19534 of 2015 (3) dt.04-09-2015 2/2 victim in her statement has not supported the FIR. On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Atulbir Singh, learned J.M., 1st Class, Madhubani in connection with Kaluahi P.S.Case no. 40 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
