JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2015 The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 3 of the Railway Property(Unlawful Possession) Act. The theft was committed in the railway army van. Subsequently recovery was made from co-accused Jitendra Kumar who named the petitioner in his confession. It is submitted by learned counsel for the petitioner that nothing has been recovered from the possession of the petitioner and a statement to that effect has been made in para 7 of the petition.

The aforesaid facts constitute ground for consideration of prayer for regular bail by learned Court below, if the petitioner surrenders within a period of six weeks and pray for regular bail in connection with Barauni Rail P.S. Case

Patna High Court Cr.Misc. No.20464 of 2015 (2) dt.05-05-2015 2/2 No. 13 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Barauni, Begusarai.

Accordingly the application is disposed of.
