JUSTICE SUDHIR SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code.

As per FIR, it is alleged that on 7.10.2014 at about 5 P.M. the informant was going to cut graves of paddy crops then all the accused persons variously armed began to abuse the informant and when the informant objected, petitioner assaulted the informant with iron rod on head causing injury. The rest accused persons also assaulted the informant. It is further alleged that the father of the informant came to save him then accused persons also assaulted the father of the informant with iron rod as a result of which the left hand of the informant's father fractured.

Patna High Court Cr.Misc. No.20669 of 2015 (2) dt.09-07-2015 2/2 It is further alleged that accused Anil Mandal pulled the sari of the informant's mother and she threshed on the earth. It has been submitted on behalf of the petitioner that the petitioner is alleged to have caused injury upon the informant. It is further submitted that from perusal of the injury report it would appear that the injuries are simple in nature. Further it is submitted that co accused have been granted anticipatory bail vide Cr. Misc. No. 4143 of 2015. Learned counsel for the State has submitted that the petitioner is named in the FIR and there is specific allegation against the petitioner.

Considering the fact that other co accused have been granted anticipatory bail, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M.,, Benipur,Darbhanga in connection with Biraul P.S.case No. 349 of 2014 , subject to the conditions as laid down u/s 438(2) Cr.P.C.
