2. The present writ petition has been filed for quashing the order vide memo no. 93/Supply dated 21.01.2012 issued by the SubDivisional Officer, West Muzaffarpur Supply Section whereby and whereunder the licence of P.D.S.

shop bearing licence no.

23020079/2008 has been cancelled and also to restore the P.D.S. shop of the petitioner.

3. At the very outset, learned counsel for the petitioner fairly accepts that remedy by way of statutory appeal before the

Patna High Court CWJC No.8586 of 2014 dt.20-07-2018 Collector is available to the petitioner against the impugned order, which has not been availed of by the petitioner.

4. In the above circumstances, the writ petition stands dismissed with liberty to the petitioner to file appropriate statutory appeal against the impugned order of cancellation.

5. It is made clear that in case such an appeal is filed, the concerned authority would have regard to the present proceeding being pursued by the petitioner, while considering any issue relating to condonation of delay, if applicable.
