JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 413 and 414 of the I.P.C. The prosecution story, in brief, is that on the alleged date and time of occurrence the informant along with other police personnel was conducting vehicle checking on SiwanMaharajganj road and during course of checking they stopped a motorcycle coming from Siwan having registration No. BR-29P2447 and the rider left the motorcycle tried to escape but they caught the motorcycle rider. On enquiry the person disclosed his name as the petitioner and on search one mobile, three motorcycle keys and a chillam was recovered from the possession of the petitioner.

No.31731 of 2016 (3) dt.23-09-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.5.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner denies the allegations made in the F.I.R. The petitioner had no knowledge regarding the motorcycle in question being a stolen property. He has remained in custody for sixteen months. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Pachrukhi P.S. case No.116 of 2015.
