Petitioner apprehends arrest in connection with Indian Forest Case No. 9 of 2018 registered for the offence punishable under sections 41 and 42 of the Indian Forest Act and sections 26( 2, 7 & 13) Bihar Chiran Mill Act. Learned counsel appearing for the petitioner submits that petitioner has been made victim of false implication due to dirty village politics. Petitioner is owner of the alleged Ara Mill in question. From the facts and circumstances of the case, no case under sections 41 and 42 of the Indian Forest Act is made out. Moreover, cognizance has been taken in this case after six years of the alleged occurrence.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Indian Forest Case No. 9 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
