JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-05-2023 The present writ petition has been filed seeking the following reliefs:- "1(i).For issuance of writ in nature of mandamus for directing and commanding the respondent's authority to make fresh measurement and demarcation of Nala of Govt. of Bihar and the declaration may with help of digitalised Maps available Gov. of Bihar at Survey office, Gulzarbag in Patna in Mauje-Jaitpur appertaining to Khata No.171 plot no.322 upon which Pucca Nala was built at length 240 feet. Whereby and

Patna High Court CWJC No.13498 of 2022(2) dt.08-05-2023 2/2 whereunder the petitioner belongs to Jhajihat Mauje Anchal amine has measured the Nala. Unfortunatly it was different demarcation as per Notice which is illegal. Where therein the petitioner has not encroached the aforesaid mentioned plot rather petitioner has not encroached the Nala.

(ii. For further direction to respondent's authorities to set aside the notice issued by the Circle officer, Pupri on 21.06.2022 as well as 10.05.2022 respectively. In which the Circle officer Pupri issued notice on encroached land 30 square feet and another measurement the encroached land of petitioner is that 52 square feet which is differ and another measurement having no encroachment by the petitioner."

After some argument, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Respondent authorities for redressal of his aforesaid grievances. Liberty, so sought, is granted.
