JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,323,324,325,379,307,354A,506 and 341 of the Indian Penal Code.

The prosecution case is that the accused persons came variously armed when co accused Panchu Yadav resorted to firing, Madho assaulted with farsa when the informant fell down then these petitioners assaulted by means of lathi when the brother of the informant came to rescue, Dharmendra Yadav assaulted by iron rod and Sheo Yadav assaulted the brother of the informant with axe. When the wife and son of the informant came to rescue,

Patna High Court Cr.Misc. No.22848 of 2015 (2) dt.22-05-2015 2/2 all the accused persons assaulted them and co accused Madho Yadav snatched gold chain from the neck of the wife of the informant.

It is submitted by learned counsel for the petitioners that other injuries of the injured have been found to be simple and only grievous injury has been caused by sharp cutting weapons. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioners in case the petitioners surrender within six weeks from today in connection with Jhajha P.S. Case No. 146 of 2014 pending in the court of learned S.D.J.M., Jamui.

This application is disposed of with the aforesaid observation/direction.
