The petitioner is apprehending his arrest in connection with Muffasil Samastipur P.S. Case No.181 of 2013 for allegedly having committed the offence under Section 376(G) of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire case against the petitioner is false and fabricated and the allegation of rape as made out in the F.I.R. is not substantiated by the medical report submitted by the duly constituted Medical Board. Learned counsel submits and has drawn my attention to Annexure 3, which is the report of the Medical Board, in which the Doctors, who had examined the informant,

Patna High Court Cr.Misc. No.19959 of 2015 (2) dt.25-06-2015 2/2 have found no evidence of rape as no external injury has been found on any part of her body or even in her private part so as to substantiate the allegation of rape.

Considering the aforementioned submissions and the document (Annexure 3) and also the fact that the petitioner has no criminal antecedents, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur, in connection with Mufasil Samastipur P.S. Case No.181 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
