====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-07-2019 Second Appeal No. 36 of 2012 stood dismissed for default for non-compliance of peremptory order, dated 29.08.2017.

It has been stated in the present application for restoration of the second appeal that it was out of sheer mistake on the part of learned counsel, who has earlier conducted the second appeal, that the peremptory order could not be complied with.

Considering the above, this application is allowed. Let S.A. No. 36 of 2012 be restored to its original file subject to compliance of the peremptory order dated 29.08.2017 within four weeks.
