JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 22-04-2015 The present application has been filed for modification of order dated 19.02.2013 passed in Cr. Misc. No. 50292 of 2012 for extending the period of surrender, whereby petitioner was granted anticipatory bail in Beur P.S. Case No. 145 of 2012, registered for the offences punishable under Sections 384, 386 of the Indian Penal Code and 25(1-B)a, 26 & 35 of the Arms Act, pending in the court of learned Chief Judicial Magistrate, Patna.
It is submitted by learned counsel for the petitioner that since the petitioner working outside he was not aware about the order and he could not surrender in time. This Court is not inclined to modify the order dated 19.02.2013 passed in Cr. Misc. No. 50292 of 2012.

No.9656 of 2015 (02) dt.22-04-2015 2/2 However, since the petitioner was granted anticipatory bail on merits there is no reason for the learned court below not to grant regular bail to the petitioner, if the petitioner surrenders before the learned court below within a period of four weeks from today. With this observation, this application is disposed of.
