1. Heard learned counsel for the parties.

2. The petitioners have preferred this application for grant of regular bail in connection with Jaynagar P.S. Case no.183 of 2023 registered under sections 307, 354B, 323, 341, 448, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, the seven named accused persons including the two petitioners herein are said to have resorted to abuse and assault. It is further stated that the petitioner no.1 caught hold of the hair of the informant and threw her on the ground. Thereafter all the accused persons assaulted Ramphal Yadav and Jai Kumar Yadav causing grievous injuries.

4. Learned counsel appearing for the petitioners

Patna High Court CR. MISC. No.56983 of 2023(3) dt.08-11-2023 2/2 submits that the petitioners have been falsely implicated in the case over a dispute relating to putting up of a pump which would be evident from the F.I.R. itself. There is case and counter case between the parties, the correct version having been given in the F.I.R. of the counter case which has been brought on record as Annexure-2 to the petition. The petitioners are in custody since 3.5.2023 and chargesheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the F.I.R. being general and omnibus in nature, the petitioners being in custody for 6 months since 3.5.2023 and investigation in the case having been concluded with submission of chargesheet, the Court directs both the petitioners to be enlarged on bail in connection with Jaynagar P.S. Case no.183 of 2023 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani.
