In this case, the petitioner is seeking anticipatory bail in connection with Sheikhpura P.S. Case No. 39 of 2019 registered for offence punishable under section 354 (B) of the Indian Penal Code and section 8 of the POCSO Act. The petitioner is a retired employee and as per allegation, he is involved in alluring and disrobing the victim girl is aged about ten years, with bad intention. The learned counsel for the petitioner submits that the petitioner is aged about 70 years old, he cannot involve in such type of crime and he has falsely been implicated in the present case.

Looking to the nature of allegation, this Court is not

Patna High Court CR. MISC. No.48411 of 2019(2) dt.05-08-2019 2/2 inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders before the court below and prays for regular bail, the court below without being prejudiced by this order will take decision in accordance with law.
