JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

Petitioner is said to have misused his privilege of bail for near about 13 years.

From perusal of the impugned order I find that petitioner was earlier on bail but he failed to make proper pairvi resulting cancellation of his bail on 31.07.2003. However, the impugned order goes to show that petitioner himself surrendered before the court below on 16.06.2016 and since then he is languishing in jail custody.
