The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Birpur (Bhim Nagar) P.S. Case No. 7 of 2019 registered for the offence punishable under Sections Sections 341, 343, 328, 302/34 of the Indian Penal Code.
The allegation is regarding the victim deceased lady having been killed by the accused persons including the petitioner herein by administering poison to the deceased victim lady.
The learned counsel for the petitioner submits that there cannot be any motive or demand of dowry inasmuch as 19 years have elapsed since the marriage of the petitioner and the
Patna High Court CR. MISC. No.47635 of 2019(3) dt.30-09-2019 2/2 deceased victim lady had been solemnized and out of the wedlock, there are three big children. It is further submitted that even the charge sheet has been filed by the Police under Section 306 of the Indian Penal Code and, therefore, at best the present case can be said to be a case of abetment of suicide. The petitioner is stated to be having a clean antecedent and is languishing in custody since 15.02.2019. Lastly, it is submitted that this Court may consider the well being of the children and with a view thereof the petitioner may be enlarged on regular bail.
Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioner, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand), with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Birpur (Bhim Nagar) P.S. Case No. 7 of 2019.
