JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 05-05-2015 It is submitted by learned counsel for the petitioners that petitioner no. 4 Ranjit Yadav has been arrested, hence, his application become infructuous and accordingly, it is disposed of.

Heard learned counsels for the petitioners and the State.

The rest four petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504, 506 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act.

No.20746 of 2015 (02) dt.05-05-2015 2/2 It is alleged that the brother of the informant went to purchase some articles from the grocery shop of co-accused Sanjay Yadav when due to the altercation the brother of the informant was assaulted when the informant and others went to rescue they were also assaulted and Rs.500/- was snatched from the pocket of the brother of the informant. It is submitted by learned counsel for the petitioners that for the petty dispute the occurrence took place when there is counter version of the occurrence also and both sides have received simple injuries.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Rahui (Bhagan Bigha) P.S. Case No. 24 of 2015 pending in the court of learned Chief Judicial Magistrate, Nalanda at Biharsharif.

With the aforesaid observation, this application is disposed of.
