Singh, learned G.A-3 for the State.

Learned counsel for the petitioner restrict his prayer only to the effect that all the formalities has been made by the petitioner in respect of lease hold property to be converted into free hold property, but Bihar State Housing Board (herein after referred to as the Board) has not fixed the conversion amount

Patna High Court CWJC No.18370 of 2021(3) dt.04-02-2023 2/3 till date and in absence of the same, they are deliberately delaying to covert the lease hold property into free hold property.

Learned counsel appearing on behalf of Board submitted that all the documents are retained by the Board and petitioner may file a detailed representation for getting his lease hold property to be converted into free hold property. Considering the rival submissions of the parties, the petitioner is directed to approach, the Managing Director, Bihar State Housing Board along with all the documents in respect to his claim for getting his lease hold property to be converted to free hold property. The Managing Director, Bihar State Housing Board should not take any technical objection as this Court finds that all the requisite documents are with the Housing Board and the Board is only liable for making payment as calculated by them.

The calculation chart must be provided to the petitioner within a period of three weeks from the date of application of the petitioner and thereafter, he is required to take appropriate legal action in accordance with law for getting the lease hold property to be converted into free hold property. Such exercise must be done within a period of three months.

Patna High Court CWJC No.18370 of 2021(3) dt.04-02-2023 3/3 directed to ensure the disposal of the application of the petitioner within the aforesaid period.

With above observations and directions, the present writ applications stands disposed of.
