JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner and learned counsel representing the State.
The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 21.01.2016 passed in Cr. Misc. No. 54131 of 2015, on the ground that the petitioner is in custody since 21.04.2015, against him there is no specific allegation rather there is general and omnibus allegation and coaccused Ashok Ram has already been allowed bail to which learned APP opposes by submitting that the doctor has found multiple injury on the person of the deceased and against the petitioner and others there is allegation for assaulting him brutally. In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected.
Patna High Court Cr.Misc. No.34951 of 2016 (2) dt.31-08-2016 However, learned C.J.M./Magistrate is directed to commit the case at once and after commitment learned trial court is directed to expedite the trial and conclude the same as early as possible, preferably within six months after keeping the same on day to day basis, if possible.
