====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 11-08-2025 Heard Mr. Nilendu Kumar Choudhary, learned counsel appearing on behalf of the petitioner and Mr. Narsingh Tanti, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Simri Bazar (Simri) P.S. Case No. 19 of 2025 registered for the offence punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
3. As per the allegation made in the FIR, the petitioner is alleged to have obtained appointment on the post of contract Teacher on the basis of forged and fabricated certificate.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.51184 of 2025(2) dt.11-08-2025 2/3 petitioner informs that petitioner has tendered her resignation, however, he is not aware, whether, the same has been accepted or she has been terminated.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.
6. Learned District Court is directed to verify from the District Programme Officer (Establishment), Darbhanga, whether the resignation of the petitioner has been accepted, which was submitted before the Principal of the School, namely, Navin Primary School, Hanuman Nagar, Darbhanga and if it is found that the same has been accepted, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his/her arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Simri Bazar (Simri) P.S. Case No. 19 of 2025, subject to the condition as laid down under Section 482(2) of the BNSS.
7. The learned District Court is directed to verify the criminal antecedent of the petitioner as stated in paragraph no. 3 of the bail application. If any other case is pending against the petitioner as what has been stated in
