The petitioner is apprehending his arrest in a case registered under Sections 25(i-B)a, 26, 29, 30 and 35 of the Arms Act. The prosecution case, in brief, is that a country-made pistol and a fired cartridge were recovered from straw house of the petitioner.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused in this case due to mistake of fact. One country-made pistol and a live cartridge were recovered from the straw house of the petitioner. The same has not been recovered from conscious possession of the

Patna High Court Cr.Misc. No.52368 of 2018 (2) dt.10-09-2018 petitioner. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 255 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
