This application is for grant of regular bail in connection with Athmalgola P.S.case No.46 of 2018 for the offences under Sections 392, 34 of the Indian Penal Code. Allegation against the petitioner as per FIR is that some unknown miscreants committed loot-pat in the house of the informant and the petitioner is not named in the FIR and later on his name transpired and looted articles have been recovered from his house, which appears form the impugned order. Submission of the learned counsel for the petitioner is that for recovery of looted articles, another case bearing Bakhtiyarpur P.S.Case No.158 of 2018 has been registered against the petitioner and except the recovery there is nothing against him.

Patna High Court Cr.Misc. No.52280 of 2018 (2) dt.05-10-2018 2/2 He is in custody since 19.5.2018.

Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that there is recovery from the house of the petitioner.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, since the petitioner is in custody, the learned trial court is directed to expedite the trial. With the aforesaid observation, this application is dismissed.
