JUSTICE RAKESH KUMAR ORAL ORDER 18-08-2016 Learned counsel for the petitioner at the very outset submits that in the address of the petitioner, District "Jamui" has incorrectly been typed in place of District "Lakhisarai". He is permitted to make correction accordingly in course of the day. Heard Sri Ajay Mukherjee, learned counsel for the petitioner and Mr. Md. Ashlam Ansari, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 20.06.2016 in Malaypur P.S. Case no.25/2016 (G.R. No.992/2016) registered for the offence under Sections 419, 465, 467, 468, 471, 120(B) of the Indian Penal Code, has prayed for grant of bail. It was alleged against the petitioner that in place of petitioner, one another person had appeared in the examination

Patna High Court Cr.Misc. No.32131 of 2016 (2) dt.18-08-2016 2/2 and after completion of the selection process, the matter was inquired and the allegation was found true. Learned counsel for the petitioner submits that in any event, for such offence without connivance with the senior officials, such offences are not possible to be committed. However, he submits that the petitioner had appeared and was selected on the post of constable. After hearing learned counsel for the parties and considering the period of custody, let the petitioner, namely, Deepak Kumar be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Malaypur P.S. Case No.25/2016 ( G.R.No.992/2016).
