The petitioner, an accused in Excise Case No. 48 of 2012 instituted under Section 47(a)(f) of the Excise Act, who is in custody since 20th May, 2016, seeks bail.

Learned counsel for the petitioner has submitted that the alleged recovery of 50 liters of illicit country made liquor is not from the conscious possession of the petitioner, rather, it has been recovered from the joint house and the petitioner has nothing to do with the alleged seized articles. It is further contended that the petitioner is ready to furnish sound sureties to the satisfaction of the court.

No.35340 of 2016 (2) dt.22-08-2016 2/2 period undergone in custody, the petitioner Manager Sahani is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Trial No. 347 of 2015 arising out of Excise Case No. 48 of 2012.
