JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-04-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 436/34 of the Indian Penal Code.

It is alleged that the petitioners put the house of the informant on fire and they were seen while fleeing away after litting the fire.

It is submitted by the learned counsel for the petitioners that for the occurrence of 25.2.2014 the FIR was registered on 27.2.2014 whereas on 25.2.2014 the informant filed a petition before the Circle officer, Wazirganj which has been brought on record as Annexure 3 to the effect that his house caught accidental fire. Patna High Court Cr.Misc. No.10624 of 2015 (2) dt.23-04-2015 2/2 over, the petitioners' side lodged Wazirganj P.S. Case No. 113 of 2012 against the informant making accusation under sections 506 and 504 IPC and section 27 of the Arms Act. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the delayed lodging of the case and the application filed before the Circle Officer, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Wazirganj P.S. Case No. 86 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
