This application is for grant of regular bail in connection with Pakari Dayal P.S.case No.114 of 2018 for the offences under Sections 341, 323, 354, 354(B) and 4/6 of the POCSO Act.

Allegation against the petitioner as per FIR is that he lifted the daughter of the informant, who is aged about six years and took her in Sareh and later on the girl was recovered in the injured condition from the bushes.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and there is no allegation of rape against the petitioner. The petitioner is in custody since 27.6.2018.

Patna High Court Cr.Misc. No.52304 of 2018 (2) dt.05-10-2018 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of seven months and if not concluded, the petitioner is at liberty to renew his prayer for bail.

With the aforesaid observation, this application is dismissed.
