JUSTICE SUDHIR SINGH ORAL ORDER 25-06-2015 The petitioner is apprehending his arrest in connection with Excise Case No. 93/2014 instituted under Sections 47(a) of the Excise Act.
Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that acting on a tip off, the informant being Excise official along with police force raided the house of the petitioner from where 70 liters country made liquore kept in two plastic bags were seized and the petitioner seeing the raiding party succeeded in fleeing away. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case. It has further been submitted that the petitioner is ready to deposit a sum of Rs. 25,000/- in the court below which shall be subject to final
Patna High Court Cr.Misc. No.20547 of 2015 (2) dt.25-06-2015 2/2 disposal of the case.
Learned counsel for the State has submitted that the petitioner is named in the FIR.
Considering the aforesaid fact, the petitioner is ready to deposit a sum of Rs. 25,000/- in court below, which shall be subject to final disposal of the case and on doing so the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri D.K.Tiwari, Judicial Magistrate, Saran at Chapra in connection with Excise Case No.93/2014, TR No. 5327 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
