In this case, the petitioner is seeking anticipatory bail in connection with Nautan P.S. Case No. 115 of 2019 registered for the offence under Section 7 of the E.C. Act. Allegation has been made that about 31 quintal of wheat has been seized from a vehicle near to the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner is a P.D.S. dealer and there is no anomaly or irregularity in the stock. He further submits that the petitioner is a witness to the incident in which his own brother has killed his father and on that account this false case been lodged and he has

Looking to the entire facts and circumstances of the case, let the above-named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Bettiah, West Champaran, in connection with Nautan P.S. Case no. 115 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
