2. The petitioner seeks bail in connection with Karakat P.S. Case No. 199 of 2022, registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
3. As per prosecution case, this petitioner along with co-accused Rajesh Kumar Singh assaulted the wife of informant, as a result of which, she sustained injury and succumbed to injury.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to property dispute. Informant is not an eye witness of the alleged occurrence. It is further submitted that during course of trial, informant Hare Ram @ Hare Ram Singh
Patna High Court CR. MISC. No.55284 of 2024(2) dt.31-08-2024 2/2 has been examined and from perusal of his deposition, it appears that he did not support the prosecution case and his statement is contrary to the F.I.R. It is next submitted that similarly situated co-accused Rajesh Kumar Singh has already been granted bail by a co-ordinate Bench of this Court vide order dated 05.12.2023 passed in Cr. Misc. No. 31429 of 2023. Petitioner is in custody since 14.05.2024.
5. Learned A.P.P. appearing on behalf of the State opposed the prayer for bail.
6. Having considered the accusation as well as the fact that co-accused Rajesh Kumar Singh having similar allegation has already been granted bail, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IX, Rohtas at Sasaram in connection with Karakat P.S.
