JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act.

One country made three-nut, one live and one empty cartridge were recovered from the house of the petitioner. Petitioner was arrested on the spot but at the time of his arrest, he disclosed that seized arm and cartridges belonged to his son. The first information report goes to show that petitioner and his son were accused in a murder case.

Submission on behalf of the petitioner is that petitioner has already been granted privilege of bail in murder case

Patna High Court Cr.Misc. No.31386 of 2016 (2) dt.19-08-2016 2/2 and he is languishing in jail custody since 30.03.2016 in connection with present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 170 of 2016.
