KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 21-12-2021 Petitioner has prayed for the following relief(s):- "For issuance of an appropriate writ/s, order/s or direction/s for setting aside the letter dt. 19th of March, 2010 (Annexure-3) by which the respondent no. 3 has communicated to the petitioner no.1 that home loan sanctioned to him, has been recalled and for a further direction to the respondents to proceed further with the loan sanctioned to the petitioners."

Learned counsel for the petitioner seeks permission to withdraw the present petition reserving liberty to approach the Ombudsman set up by Reserve Bank of India for redressal of the

Patna High Court CWJC No.4132 of 2021(2) dt.21-12-2021 2/2 grievances.

Prayer allowed.

The present application is, accordingly, disposed of as withdrawn reserving liberty to the petitioner to approach the Ombudsman concerned within a period of four weeks from today. If such a representation is filed by the petitioner within the stipulated time, the authority concerned is directed to consider the same and dispose it of expeditiously and preferably within a period of three months.

Needless to say that while considering such request, principles of natural justice shall be followed and due opportunity of hearing afforded to the parties.

If aggrieved by the said order, the petitioner shall have liberty to approach this Court by way of separate petition(s), if so required and desired.

Interlocutory application, if any, shall also stand disposed of.
