2. The petitioners are in custody in connection with Forbisganj P.S. Case No. 774 of 2024 for the offence punishable under sections 103(1), 3(5) of the BNS, 2023 lodged on 27.12.2024.
3. As per the prosecution story, the informant alleged that his sister was married to Babul Mandal thirteen years ago and were blessed with four children but was always tortured for dowry. On 15.12.2024, he got information about the killing. They reached the place and found the dead body, which followed the FIR.
4. Learned counsel for the petitioners submit that they
Patna High Court CR. MISC. No.49740 of 2025(2) dt.11-08-2025 2/3 are brother-in-law (devar) and sister-in-law (gotni), living separately before the alleged occurrence, had no role to play either in the demand and/or the alleged killing. The last submission is that the husband is in custody.
5. Learned APP opposes the prayer for bail submitting that the allegation is there against all the family members.
6. Taking into account the aforesaid facts as also that they are living separately and are in custody since 24.05.2025, an undertaking has been given that they shall be diligently appearing in trial, in that background, this Court is inclined to extend them the privilege of bail with conditions.
7. Let the petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned CJM, Araria, in connection with Forbisganj P.S. Case No. 774 of 2024 subject to the following conditions:
(i) one of the bailor should be the family member of the petitioners who shall provide official document to show his/her bona fide;
(ii) the petitioners shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their

(iii) the petitioners shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioners shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds. (Rajiv Roy, J) Vijay Singh/- U T
