JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under various sections of the Arms Act. Four semi-finished barrels of pistol and eighty cartridges are said to have been recovered from a room situated adjacent to the house of the petitioner but covered by a boundary. Submission on behalf of the petitioner is that the aforesaid room does not belong to the petitioner and as a matter of fact, nothing has been recovered from conscious possession of the petitioner. It is also submitted that petitioner is in jail custody since 26.04.2016.

No doubt, earlier petitioner was made accused in a

Patna High Court Cr.Misc. No.36854 of 2016 (2) dt.05-09-2016 2/2 case of Arms Act but considering the facts of the present case as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Munger in connection with Jamalpur P.S. Case No. 77 of 2015.
