JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-10-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Earlier prayer for bail of the petitioners was rejected by this court vide order dated 25-01-2016 passed in Cr. Misc. No. 44618 of 2015 and analogous case and, again I do not find any new ground to release the petitioners on bail and accordingly, their prayer for bail in connection with Raushanganj P.S. Case No. 57 of 2015 is again rejected.
However, the report of learned In-charge, learned Sub Divisional Judicial Magistrate, Sherghati, Gaya goes to show that the case of petitioners has not been committed to the court of sessions as two co-accused are still absconding. In the aforesaid circumstances, the learned Sub
Patna High Court Cr.Misc. No.31505 of 2016 (3) dt.19-10-2016 2/2 Divisional Judicial Magistrate, Sherghati, Gaya is directed to commit the case of these petitioners in accordance with law within two weeks from the date of receipt/production of copy of this order, even by separating their cases from the case of other accused.
