2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code.

3. Petitioner, who is husband of opposite party no2., is said to have ousted the opposite party no.2 from her matrimonial home in association of his family members over the dowry demand.

The matter was earlier sent to Mediation Center for arriving at an amicable settlement, and it would appear from the mediation report that the mediation has been successful and certain terms and conditions have been agreed upon by both the parties. Today, learned counsel for O.P. No. 2 is supplying a copy of the bank account to the learned counsel for the petitioner to enable him to deposit the money in the said bank account of the O.P. No. 2.

Considering the fact that the parties have reached an amicable settlement, I am inclined to grant the privilege of anticipatory bail to the petitioner on the ground that the parties would strictly abide by the terms and conditions settled between them before the Mediation Center. Let the above named petitioner, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Patna City, in connection with Complaint P.S. Case No.221 of 2023 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section (2) of the B.N.S.S., 2023 and subject to the further condition that the petitioner shall co-operate in the investigation/trial.

6. In view of the terms of the settlement, according to which out of the total settlement amount of Rs.9,00,000/-, the first installment of Rs.3,00,000/- will be paid by the petitioner and only thereafter, he would be furnishing the bail bonds.

7. In case, the parties do not cooperate and if the petitioner fails to make the payment agreed upon, the O.P. No.2 would have the liberty to pray for cancellation of bail.

8. With the above observations, the application is disposed of.
