10-02-2017 Heard Sri Dhaneshwar Prasad Gupta, learned counsel for the petitioner.

The present petition has been filed by the husband, arraying his wife, as opposite party no. 1, with a prayer to direct for transferring Miscellaneous Case No. 64 of 2014 filed under Section 125 of the Cr.P.C. by wife of the petitioner from the court of learned Principal Judge, Family Court, Gaya to the court of learned Principal Judge, Family Court, Rohtas at Sasaram. Learned counsel for the petitioner has taken the plea that whenever petitioner appears at Gaya court, he always apprehends misbehaviour from the brother of his wife. This is the ground for transferring the record.

The Court is of the opinion that in such cases, convenience of wife is required to be appreciated, not the husband.

Patna High Court MJC No.990 of 2015 (2) dt.10-02-2017 2/2 There is no reason to pass any favourable order. The petition stands dismissed.
