The petitioner is apprehending his arrest in a case registered under Sections 323, 307 and 34 of the Indian Penal Code.

The prosecution allegation, in short, is that while the informant along with two daughters were returning from the college of her daughters, the accused persons assaulted her daughter due to which she sustained injury.

It has been submitted on behalf of the petitioner there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There was a previous enmity between the parties.

Patna High Court CR. MISC. No.48366 of 2019(3) dt.27-11-2019 2/2 Hence, the present case has been instituted. On behalf of the State, it is submitted that the petitioner is named in the F.I.R. Specific allegation of assault is alleged against the petitioner. The injury report supports the allegation made in the F.I.R. The petitioner has criminal antecedents.

Considering the same, I am not inclined to grant anticipatory bail to the petitioner in connection with Shikarpur P.S. Case No. 129/19, G.R. No. 1209/19. The prayer is rejected. (Sudhir Singh, J) Pankaj/- U T
