JUSTICE SUDHIR SINGH ORAL ORDER 20-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. Allegation is that some unknown miscreants have committed murder of wife of the informant.

It has been submitted on behalf of the petitioner that he is in custody since 30.5.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is not named in the F.I.R. In course of investigation it has come that petitioner was seen fleeing away from the place of occurrence along with other persons. The said persons have been granted bail vide Annexures-2 & 3 to the present application.

On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.31909 of 2016 (3) dt.20-09-2016 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Bathnaha P.S. Case no. 138 of 2012.
