The petitioners are apprehending their arrest in connection with Pathamari P.S. Case No.01/2017, registered for the offence punishable under Sections 429, 295(A), 120(B) of the Bihar Preservation and Improvement of Animal Act. The allegation against the petitioners alongwith other accused persons is of buying and purchasing the cattles by illegal manner.
Learned counsel for the petitioners submits that the petitioners are innocent and have not committed any offence as alleged. They are falsely implicated in this case. The petitioners are Khalasi of the truck. He further submits that the driver of the
Patna High Court CR. MISC. No.8047 of 2021(2) dt.30-11-2021 2/2 said truck has already been granted regular bail. The owner of the said truck has also been granted anticipatory bail by coordinate Bench of this Court vide order dated 28.08.2020 passed in Cr. Misc. No.85315/2019.
In the aforesaid facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj, in connection with Pathamari P.S. Case No.01/2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Sandeep Kumar, J) amitkumar/- U T
